Sir Cliff Richard wins privacy claim against BBC
Mr Justice Mann gave judgment today on liability and some damages and contribution issues in this well-publicised case. He found the BBC liable for misuse of private information. The total award of general and aggravated damages is £210,000 with responsibility for £185,000 of this sum being split 65/35 between the BBC and South Yorkshire Police, who had already settled. A further trial on special damages is to follow. The case raises serious questions about the ability of the media to report on criminal investigations, the availability of damages for reputational harm in a privacy action, and the ability of public authorities to pursue contribution claims against the media. The BBC is considering seeking permission to appeal.
