CFA Success fees in defamation to be capped at 10%

Jack Straw has put a Statutory Order before Parliament which, if approved, will limit the maximum success fee to 10% in all defamation cases in which solicitors or counsel are on a conditional fee agreement and which are entered into after the coming into force of the Order in April. "Defamation" proceedings for the purposes of this Order include defamation, malicious falsehood and breach of confidence involving publication to the public at large. The Ministry of Justice website reports that this is intended to be an interim measure while Lord Justice Jackson's proposals for reform are considered.
